Welcome to Handi Biryani ("Handi Biryani", "Company", "we", "us", or "our").

These Terms & Conditions ("Terms", "Terms & Conditions") govern your access to and use of the Handi Biryani mobile application, website, online ordering services, food delivery services, restaurant services, and related products and services (collectively, the "Services").

By downloading, accessing, registering for, or using the Handi Biryani application or placing an order through our Services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

If you do not agree with these Terms, please do not use the Handi Biryani application or Services.

These Terms are intended to establish clear rules regarding account usage, food ordering, payments, delivery, cancellations, refunds, food safety, privacy, security, intellectual property, and responsible use of our Services.

Handi Biryani is a food and restaurant business providing customers with access to food products, including biryani, meals, beverages, and other menu items offered through our restaurants and digital ordering channels.

Availability of products, services, delivery areas, payment methods, promotions, and operating hours may vary by location.

You must provide accurate information and use the Services only for lawful purposes.

By using our Services, you confirm that:

• You have the legal capacity to enter into these Terms.
• You will use the Services only for legitimate purposes.
• You will comply with applicable laws and regulations.

Account deletion may be initiated through the account settings/deletion functionality available within the application.

When an account deletion request is received, we will process the request in accordance with our Privacy Policy and applicable law.

Certain information may need to be retained where legally required or reasonably necessary for:

• Dispute resolution
• Legal claims
• Regulatory compliance
• Transaction records required by law

Such retained information will only be retained for the applicable legitimate or legal purpose and will not be retained longer than reasonably necessary.

Google Play requires apps that support account creation to provide users with an accessible account-deletion mechanism and corresponding data-deletion disclosures.

Customers may place food orders through the Handi Biryani application, website, or other officially supported ordering channels.

When placing an order, you are responsible for:

• Selecting the correct products;
• Selecting the correct quantity;
• Providing an accurate delivery address;
• Providing a valid phone number;
• Selecting the appropriate payment method;
• Reviewing the total order amount before confirmation.

An order is considered submitted when you successfully complete the ordering process.

All orders remain subject to acceptance and availability.

After an order is placed, we may provide an order confirmation through:

• Email;

• Other available communication channels.

An order may be rejected, modified, or cancelled when reasonably necessary, including in circumstances such as:

• Restaurant closure;
• Incorrect pricing;

• Delivery-area limitations;
• Unsafe delivery conditions;
• Payment failure;
• Suspected fraud;
• Duplicate orders;
• Incorrect customer information;
• Events beyond our reasonable control.

Where a prepaid order is cancelled by us and a refund is applicable, the applicable amount will be processed according to the relevant refund procedure.

We make reasonable efforts to ensure that menu information, photographs, descriptions, prices, and availability are accurate.

However:

• Food presentation may vary from photographs.
• Ingredients and recipes may change.
• Products may become unavailable without advance notice.
• Product availability may vary between branches.
• Prices may change from time to time.
• Certain customization requests may not always be available.

The final price displayed at checkout before order confirmation will generally apply to that order.

All prices displayed through our Services will be shown in the applicable currency.

Depending on the order, the total amount may include:

• Food/product price;
• Applicable taxes;
• Delivery charges;
• Packaging charges;
• Service charges, where applicable;
• Other clearly disclosed charges.

Any applicable charges will be displayed before order confirmation wherever technically possible.

Handi Biryani may update menu prices, delivery charges, promotions, and other fees at any time.

A pricing error may result in an order being cancelled or corrected. Where payment has already been received for an order that cannot be fulfilled because of a pricing error, an applicable refund may be issued.

• Cash on Delivery;

• Digital wallets;
• Mobile banking;
• Other supported payment gateways.

Payment availability may vary by location and order.

Payments processed through third-party payment providers may be subject to those providers' own terms and privacy policies.

Handi Biryani does not intentionally store complete payment-card credentials when such information is processed directly by a third-party payment provider.

Payment information must be accurate and valid.

An order may not be completed if payment is unsuccessful, declined, reversed, disputed, or otherwise invalid.

Handi Biryani is committed to complying with applicable Google Play Developer Program Policies when distributing the Handi Biryani application through Google Play.

The Handi Biryani application primarily facilitates the purchase and delivery of physical food products and restaurant services.

Where applicable, payments for physical food and food-delivery services may be processed using supported external payment methods or payment providers in accordance with applicable Google Play policies.

Google Play's Payments policy states that its billing system is not required for purchases of physical goods and physical services such as food delivery.

Nothing in these Terms should be interpreted as overriding any mandatory Google Play policy, applicable law, or regulatory requirement.

Customers should review their order carefully before confirming it.

Where supported, an order modification or cancellation may be requested shortly after placing the order.

Once food preparation has started, modifications or cancellations may no longer be possible.

Customers should contact Handi Biryani as soon as possible if an urgent correction is required.

Delivery availability depends on:

• Customer location;
• Delivery service area;
• Restaurant operating hours;
• Product availability;
• Delivery capacity;
• Weather;
• Traffic;
• Road conditions;
• Other operational circumstances.

Estimated delivery times are estimates and are not guaranteed.

Delivery may take longer during:

• Peak meal periods;
• Weekends;
• Public holidays;
• Festivals;
• Severe weather;
• Traffic congestion;
• High-volume periods.

We will make reasonable efforts to deliver orders within the estimated timeframe.

Customers must provide a complete and accurate delivery address.

This may include:

• Building/house number;
• Street;
• Area;
• Landmark;
• Contact number;
• Additional delivery instructions.

Handi Biryani will not be responsible for delays or failed deliveries caused by incorrect or incomplete information provided by the customer.

Additional delivery charges may apply where a customer requests a significant change of delivery location after dispatch.

A delivery may be considered unsuccessful if:

• The customer cannot be reached;
• The provided address is incorrect;
• The customer is unavailable;
• The customer refuses the order without a valid reason;
• The delivery location is inaccessible;
• The delivery location is unsafe;
• The customer does not follow reasonable delivery instructions.

In such circumstances, refunds may not be available where the failure resulted from the customer's actions or incorrect information.

Repeated fraudulent or intentionally failed orders may result in account restrictions or termination.

Handi Biryani is committed to maintaining appropriate food preparation, hygiene, handling, storage, packaging, and delivery practices.

We aim to:

• Use appropriate food ingredients and supplies;
• Maintain kitchen hygiene;
• Follow applicable food safety requirements;
• Properly store food;
• Maintain appropriate food handling procedures;
• Train relevant staff on food safety procedures;
• Package food appropriately for delivery.

Customers should not consume food that appears:

• Spoiled;
• Contaminated;
• Tampered with;
• Unusual in smell or appearance;
• Otherwise unsafe.

Customers should immediately contact us if they have concerns regarding food safety.

Customers are responsible for informing Handi Biryani about relevant allergies or dietary requirements before ordering where such communication is available.

Our food may contain or come into contact with ingredients including, but not limited to:

• Dairy;
• Nuts;
• Peanuts;
• Gluten;
• Eggs;
• Soy;
• Spices;
• Other ingredients that may cause allergic reactions.

Because food may be prepared in environments where multiple ingredients are handled, we cannot guarantee that cross-contact will never occur.

Customers with serious or life-threatening allergies should contact Handi Biryani before ordering and make an informed decision about whether the product is suitable for consumption.

Customers may request cancellation as soon as possible after placing an order.

Cancellation may be permitted before food preparation begins.

Once preparation has started, cancellation may not be possible because food may already have been prepared specifically for the customer.

Handi Biryani may cancel an order where reasonably necessary due to:

• Product unavailability;
• Restaurant operational issues;
• Technical problems;
• Payment issues;
• Delivery limitations;
• Safety concerns;
• Fraud concerns;
• Force majeure circumstances.

Where Handi Biryani cancels a prepaid order and a refund is applicable, the relevant amount will be returned using the applicable payment/refund process.

Refunds may be considered in circumstances including:

• Order cancelled by Handi Biryani;
• Missing items;
• Incorrect items;
• Significant order discrepancies;
• Food that is clearly unsafe or defective;
• Duplicate payment;
• Payment taken for an order that was not successfully fulfilled.

Refund eligibility may depend on the circumstances of the case.

Customers should report food or order-related problems as soon as reasonably possible after delivery.

We may request:

• Order number;
• Photographs;
• Receipt/payment confirmation;
• Description of the issue;
• Other reasonable information necessary to investigate the complaint.

Refunds may not normally be provided solely because of:

• Personal taste preferences;
• Change of mind after food preparation;
• Incorrect customer address;
• Customer unavailability;
• Failure to receive the order due to customer fault;
• Consumption of the majority or entirety of the order before reporting an issue;
• False or fraudulent complaints.

Refund processing times may depend on the payment method and payment provider.

Handi Biryani may provide:

• Promotional codes;
• Discounts;
• Coupons;
• Loyalty benefits;
• Special offers;
• Limited-time campaigns.

Promotional offers may have additional conditions, including:

• Minimum order values;
• Expiration dates;
• Specific products;
• Specific branches;
• Geographic limitations;
• Customer eligibility requirements.

Unless explicitly stated, promotional offers cannot be combined.

Handi Biryani may cancel or restrict promotions where misuse, fraud, technical errors, or abuse is identified.

Where reviews, ratings, comments, photographs, or other user-generated content are supported, users must provide genuine and lawful content.

Users must not submit:

• False reviews;
• Fraudulent claims;
• Threats;
• Harassment;
• Hate speech;
• Abusive content;
• Defamatory content;
• Illegal content;
• Personal information belonging to another person;
• Content intended to manipulate ratings or promotions.

Handi Biryani may remove or restrict content that violates these Terms or applicable law.

Where required for Google Play compliance, appropriate reporting and moderation mechanisms will be maintained for user-generated content. Google Play requires apps hosting UGC to maintain clear terms and appropriate moderation/reporting mechanisms.

You agree to use the Services responsibly.

You must not:

• Place fake or fraudulent orders;
• Abuse promotional offers;
• Attempt unauthorized access;
• Hack or attack our systems;
• Introduce malicious software;
• Scrape our platform without permission;
• Use automated bots to abuse the Services;
• Harass our employees or delivery personnel;
• Submit fraudulent refund claims;
• Impersonate another person;
• Use another person's account without authorization;
• Interfere with application functionality;
• Attempt to reverse engineer the application except where expressly permitted by law;
• Use the Services for unlawful purposes.

Violations may result in:

• Order cancellation;
• Account restrictions;
• Account suspension;
• Account termination;
• Loss of promotional benefits;
• Legal action where appropriate.

Handi Biryani respects the privacy of its users.

We do not sell personal information to advertisers or unrelated third parties.

However, certain information may need to be processed or disclosed to trusted service providers when reasonably necessary to provide the Services.

The Privacy Policy should be publicly accessible and available within the application and through the Google Play Store listing where required.

All intellectual property associated with Handi Biryani, including:

• Website;
• Graphics;
• Photographs;
• Videos;
• Menu content;
• Product descriptions;
• Software;
• Source code;
• Databases;
• Designs;
• Marketing materials;
• Other proprietary content

is owned by or licensed to Handi Biryani Private Limited unless otherwise stated.

You may use the application only for legitimate personal use and in accordance with these Terms.

You may not, without appropriate authorization:

• Copy our application;
• Reproduce our content;
• Distribute our content;
• Modify our software;
• Reverse engineer the application where prohibited by law;
• Scrape our data;
• Reproduce our branding;
• Use our trademarks commercially;
• Create unauthorized derivative works.

Subject to these Terms, Handi Biryani grants you a limited, non-exclusive, non-transferable, revocable license to access and use the application for its intended purpose.

This license does not transfer ownership of the application or any intellectual property to you.

You may not use the application for unauthorized commercial purposes or attempt to circumvent its security or technical restrictions.

The application may integrate with third-party services such as:

• Mapping services;
• Hosting providers;
• Analytics services;
• Notification services;
• Authentication services;
• Delivery services;
• Other technical service providers.

Third-party services may have separate terms and privacy policies.

Handi Biryani is not responsible for third-party services that are outside our reasonable control, although we will make reasonable efforts to work with reliable service providers.

We aim to provide reliable and secure Services.

However, we do not guarantee that:

• The application will always be available;
• The application will always be error-free;
• Every product will always be available;
• Delivery will always occur within an estimated time;
• All features will always be available;
• The Services will never experience interruptions.

Temporary interruptions may occur because of:

• Maintenance;
• Software updates;
• Server issues;
• Internet/network failures;
• Security incidents;
• Payment provider issues;
• Third-party service failures;
• Power outages;
• Natural disasters;
• Other circumstances beyond our reasonable control.

Handi Biryani will not be responsible for delays or failures caused by circumstances beyond our reasonable control.

Such circumstances may include:

• Earthquakes;
• Floods;
• Fires;
• Severe weather;
• Epidemics or pandemics;
• Government restrictions;
• Civil unrest;
• Strikes;
• Transportation disruptions;
• Road closures;
• Power failures;
• Internet or telecommunications failures;

• Other extraordinary events.

We will make reasonable efforts to resume normal Services as soon as practical.

To the maximum extent permitted by applicable law, Handi Biryani will not be responsible for indirect, incidental, special, consequential, or unforeseeable losses arising from the use of the Services.

This may include losses resulting from:

• Temporary service interruption;
• Delivery delays;
• Incorrect information provided by customers;
• Third-party service interruptions;
• Customer misuse of the Services;
• Events outside our reasonable control.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law, including liability arising from fraud or other legally protected rights.

Handi Biryani may suspend or terminate an account where reasonably necessary, including where:

• These Terms are violated;
• Fraud is suspected;
• Illegal activity is identified;
• Payment abuse occurs;
• Promotional abuse occurs;
• The platform is attacked or misused;
• Staff or delivery personnel are abused or threatened;
• The account presents a security risk.

Where appropriate and legally permitted, we may provide notice before termination.

Termination does not eliminate obligations that accrued before termination.

Users may stop using the Services at any time.

Users may request deletion of their account according to the account deletion process described in these Terms and our Privacy Policy.

Any outstanding financial obligations may remain payable after account deletion.

Account deletion does not necessarily erase transaction records that Handi Biryani is legally required to retain.

Handi Biryani intends to comply with applicable Google Play Developer Program Policies for the distribution and operation of the application.

This includes, where applicable:

• User data requirements;
• Privacy requirements;
• Data Safety disclosures;
• Account deletion requirements;
• Appropriate permission usage;
• Payment requirements;
• Intellectual property requirements;
• Content requirements;
• Security requirements;
• User-generated content requirements;
• Applicable app quality and technical requirements.

We will maintain our Google Play disclosures and policies so that they accurately reflect the actual functionality and data practices of the application.

Users should understand that Google Play policies may be updated from time to time, and Handi Biryani may update its application and policies accordingly.

Google Play requires developers to keep the Data Safety disclosures accurate and consistent with actual application data practices.

Handi Biryani may update these Terms from time to time.

Changes may be made because of:

• New features;
• Changes to our Services;
• Changes in applicable law;
• Security improvements;
• Operational changes;
• Changes in Google Play requirements;
• Changes in payment or delivery services.

When material changes are made, we may provide notice through appropriate channels.

Continued use of the Services after the updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

These Terms shall be governed by the applicable laws of Nepal.

Any dispute relating to the Services or these Terms shall first be addressed through good-faith communication between the customer and Handi Biryani.

Where a dispute cannot be resolved informally, it may be subject to the jurisdiction of the competent courts of Nepal, subject to applicable law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain effective to the extent permitted by law.

The invalid provision will be interpreted or modified to the minimum extent necessary to make it legally enforceable where permitted.

If Handi Biryani does not immediately enforce any provision of these Terms, that does not mean that we have waived our right to enforce that provision later.

These Terms, together with the Handi Biryani Privacy Policy and other applicable policies or notices provided through the Services, constitute the agreement governing your use of the Handi Biryani Services.

These Terms may be made available in multiple languages for user convenience.

Where permitted by applicable law, the English version will be used as the reference version in the event of an inconsistency between translations.
